Welcome to The More You Grow. By using our mobile application (the "App"), you agree to these Terms of Service ("Terms"). Please read them carefully.
1. About the Service
The More You Grow is a hyperlocal marketplace connecting home gardeners with neighbors in the Portland, Oregon area. Through the App, gardeners may list fresh produce and live plant starts for sale, and buyers may browse, order, and arrange pickup or delivery. We provide the platform; all transactions are between individual gardeners and buyers.
2. Eligibility
You must be at least 18 years old to use the App. By creating an account, you represent that the information you provide is accurate and complete.
3. Accounts
- You are responsible for maintaining the security of your account and password.
- You must provide a valid email address and verify it before using the App.
- You may not use another person's account without their permission.
- Identity verification is optional. Gardeners who complete verification may display a "Verified" badge on their public profile. Verification confirms identity only; it is not an endorsement of the gardener or the items they sell.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. For Gardeners (Sellers)
- You are responsible for the accuracy of your listings, including descriptions, quantities, pricing, and any claims about growing methods.
- Produce. All produce sold must be unprocessed and must comply with Oregon's Farm Direct Marketing regulations. Annual direct sales of qualifying produce must remain under the threshold required to claim Oregon's Farm Direct exemption (currently $20,000). You are responsible for tracking your own sales against this threshold.
- Plant starts. Live plants, seedlings, and starts are nursery stock and are subject to separate Oregon Department of Agriculture (ODA) requirements. Under current ODA rules, sellers with annual gross sales of nursery stock at or below $250 are not required to hold an ODA nursery license; sellers above that threshold must obtain a license before listing plant starts. You are solely responsible for tracking your nursery-stock sales against this threshold and for obtaining any license or permit that applies to you. The Farm Direct exemption does not cover nursery stock.
- You are responsible for food safety, the quality of produce or plants you sell, and any plant-health or pest-quarantine rules that apply to nursery stock.
- You must fulfill confirmed orders within the stated availability window.
- Listings that are not refreshed or fulfilled may be flagged as stale and automatically expired by the App.
- Stripe account setup is required to receive payments.
5. For Buyers (Consumers)
- Orders are commitments. Please only place orders you intend to pick up or receive.
- You are responsible for picking up orders within the agreed-upon window.
- Produce and plant starts are sold as-is by individual gardeners, not by The More You Grow.
6. Payments & Fees
- All payments are processed securely through Stripe.
- A 10% platform fee is applied to each transaction. Gardeners receive 90% of the sale price.
- Delivery orders may include an additional delivery fee.
- Refund policies are handled on a case-by-case basis. Contact us if you have an issue with an order.
7. Prohibited Conduct
You agree not to:
- Sell processed foods, alcohol, cannabis, or any regulated substances through the App.
- List nursery stock without complying with applicable ODA requirements.
- Misrepresent the origin, quality, or nature of produce or plants.
- Harass, threaten, or abuse other users.
- Use the App for any illegal purpose.
- Attempt to circumvent the platform's payment system.
- Create multiple accounts or impersonate others.
8. Public Profiles, Search & Following
- Gardener accounts have a public profile that is discoverable through search and browsable by other users. Your public profile may include your display name, profile photo, bio, garden description, ratings, reviews, active listings, and approximate location.
- Other users may "follow" a gardener. Following is visible to the gardener and triggers notifications to the follower when the gardener posts new harvests or plant starts.
- Buyer accounts are not publicly browsable, but a buyer's display name and review may appear on a gardener's public profile when the buyer leaves a review.
9. Notifications & Communications
By using the App, you agree to receive transactional and account-related communications, including order updates, pickup reminders, password-reset codes, and notifications about gardeners you follow. Push notifications can be managed in your device settings; in-app notification preferences can be managed from the Profile screen.
10. Reviews & Ratings
Users may leave reviews after completed orders. Reviews must be honest and based on your actual experience. We reserve the right to remove reviews that are abusive, fraudulent, or violate these Terms.
11. Reporting & Trust and Safety
If you encounter a listing, profile, or message that you believe violates these Terms or applicable law, you may report it through the in-app report flow. We review reports at our discretion and may remove content, restrict features, or suspend or terminate accounts based on the outcome of our review. Submitting a false or abusive report is itself a violation of these Terms.
12. Intellectual Property
The App, its design, and its content are owned by The More You Grow. You retain ownership of content you upload (photos, descriptions) but grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce it within the App and in connection with operating and promoting the service.
13. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind. We do not guarantee the quality, safety, or legality of produce or plants listed by gardeners. We are a marketplace platform, not a party to transactions between gardeners and buyers.
14. Limitation of Liability
To the maximum extent permitted by law, The More You Grow shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to foodborne illness, plant disease or pest issues, failed deliveries, or payment disputes.
15. Account Deletion
You may delete your account at any time from the Profile screen in the App. Deletion is permanent and removes your personal data, listings, and order history. Records we are required to retain for legal, tax, or fraud-prevention reasons may be kept in accordance with applicable law.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of material changes.
17. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.
